Justice for me!

I have just received a thick envelope from the Ministry of Justice with the decision by Judge David Harvey in relation to the Harassment proceedings that were brought against me by Madeleine Flannagan and Debbie Brown.

I am grateful to Judge Harvey for the obvious amount of time and attention that he put in to this.

CASE DISMISSED!

And i didn't even have a lawyer.

Thank you God for answering my prayers and allowing the truth to prevail.

Simon Buckingham and Madeleine Flannagan should hand in their LLBs and go back to Law school. This kind of abusive and vexatious litigation is not what our courts are for.

Not only has this case been dismissed but Judge Harvey also heavily criticised another Judge's decision in a previous harassment case brought against me.

I would write more about the decision but i have been through hell and back with this case, and now i just want to focus on my education.

I am forgetting about this - and forgiving both of them.

well done J!...Victory is very sweet- vindication on both a personal level and for freedom of speech in blogsville..and It's utter humiliation and defeat for that bunch of narcissistic haters- sorry I mean, the applicants and their legal dream team..what a joke they have turned out to be! Their failures here are numerous and profound. Remind me what LLB stands for again? in this case its 'lame legal brains' surely? cant wait for the herald on sunday follow up!

From one of the final paragraphs in the Judge's decision;

"Debate is robust. Personal attacks, whether we like them or not, abound. And the expression of ideas, however banal, are aided by the communications technologies undreamed of 60 years ago. With the availability of these technologies so too has arisen the citizen publisher and those who were described by President Nixon as "the silent majority". Many are silent no longer."

I knew there was a reason - other than him trying to end the Vietnam War - that i was a fan of Richard Nixon to the point where i named my dog after him!

Simon Buckingham and Madeleine Flannagan should go find themselves alternative employment.

Bloody good job. I always thought Buckingham lacked intellectual nous and should never have qualified as a lawyer. And both he and her are bonkers. Really, there should be some repercussions for them both for wasting court time.

It'd be interesting at some point to read all the decision too if you get a chance.

I am not going to publish any of the contents of the Judge's decision. To do so would be carrying this on.

He has clearly stated though that they had not suffered any "distress" due to anything that i had written and that if they had suffered "distress" that was caused by them - and their refusal to stop reading my blog. He has stated that a reasonable person in their position would not have suffered distress due to my actions.

I am not quite sure how or why Madeleine could be claiming this to be a victory - or defaming me on her blog - as i have heard that she is doing. I am not sure how she could be threatening to now be considering suing me for defamation when their very own affidavits clearly confirm that anything i had said about them is true there for could not be considered defamation - but that is her their deal.

If they want to waste more time and money on this only to embarrass themselves further - well - that is their deal.

I am also not sure why when asked about the judgement after declaring victory she is saying it would be "contempt of court" to talk about it and that only the parties involved are privy to it.

The Herald on Sunday had a copy of the judgement before i even had it and Judge Harvey clearly states;

"I have given consideration to the exercise of my powers pursuant to s 39 pf the Harassment Act and make an order prohibiting publication of the names or information that may identify the applicants. I do not consider such an order justified. As i have said, both applicants have pute themselves in the public arena especially within the context of the internet. That they have undertaken this litigation has not only been mentioned in the blogosphere but in the mainstream media. As is so often the case with information that is on the internet, to make a non -publication order would now be an exercise in futility. Furthermore, there is no significant individual interest that trumps the public interest in the openness of the Court proceedings. There is no doubt that some of the material that features in this case is embarassing but Ms. Flannagan, as a lawyer, will be aware that often publicity follows cases involving people with a profile and this is certainly one of them."

Not sure why Madeleine is lying about anyone who was not involved in the case being in contempt of court if they have read the judgement but then it doesn't surprise me. I have gotten used to being on the receiving end of the effects of her dishonesty lately.

Despite that - I am choosing to forgive and move on.

Awesome. I look forward to creating a blog that will defame you within an inch of your life. The precedent has been set and the bar raised extremely high.

Your problem is of course that the court found that you were the aggressor, so any claim to grant forgiveness is just more harassment.

Cool. Now forget this happened. Enjoy your stress-free life from now on! (though there's always some other stress isn't there? Life is tough...)

Congratulations!!!!!!

When do you hear about your law society complaints?

Jacqueline said...

I don't know.

I have received confirmation of my complaint from the Law Society regarding Simon Buckingham. I am considering making another complaint regarding his conduct in relation to threats that he made to me the evening prior to this case being heard regarding having the judge deem my behaviour to be a criminal matter.

Re my complaint regarding Madeleine - i have not yet heard back from the Law Society other than confirmation that they had received it - regarding that complaint. I am also considering making another complaint in relation to her conduct since the last one i submitted to them.

If i am allowed to - i will advise how they went when i hear - however it is my understanding that the Law Society also publishes that information on their own website.

You so should. Do keep us updated. I bet they won't be impressed with her at all.
Did you see that Madelyn write on her blog that her boss doesn't think your a real christian.?Wonder what her boss would make of that. Ha ha.
Go hard Jacks.

Jacqueline said...

Nope. I haven't seen anything that they have written about me. Like Judge David Harvey said - if you constantly watch and interact with people that you don't like on the internet then you only have yourself to blame if you feel "distressed".

I have always known that having those women in my life was not good or healthy for me - so i do not seek them out.

I have heard various things that they have been saying. Someone emailed me regarding the attempted "demonisation" of me all over the blogosphere by them and wondering if it has something to do with their hurt pride over losing the case.

I have heard about a hilarious meltdown on Cactus Kate where they posted the parts of the judgement that criticised me - and neglected to type out the 150 paragraphs that totally slammed them and their behaviour.

If i read all of that i would be tempted to ignore Judge Harvey's advice and respond by typing out the parts of the judgement that make them look like the absolutely psycho fools that they are.

I would prefer to sit back and continue to smile and bask in my victory.

Everything they are doing and saying in recent days just gives me defence in the event that they ever try to do anything like that to me again.

They are proving that i was right. They are obsessed stalkers.

Re her boss thinking i am not a real Christian. I am not sure why she thinks i would care what someone that i don't know thinks of me.

Projection possibly - Judge Harvey did state in the judgement that much of Debbie's "distress" appeared to be over her concern in regards to what strangers who she doesn't know and who did not even know who she was think of her - rather than actual hurt feelings.

Honestly - life is too short to be worrying about the opinions of strangers. Her boss can think whatever she wants to think.

I guess i better follow that up then huh!

Thanks for alerting me to the fact that it may have gotten lost in the process.

I shall follow this up first thing in the morning.

Unfortunately for you - i am not the liar.

Your horse is.

Cheers!

I can confirm now that the Law Society have received and are investigating my complaint regarding Madeleine Flannagan's conduct in this matter that was made on the 28th of May.

Thank you for taunting me and again falsely accusing me of lying. I might not have bothered following it up and may have just let it go had you not done that.

Much appreciated. :)
